Cumulative Delivery Failure WindowShell Energy suggests a period of two years rather than five as stated in the BPM and Tariff.  A five-year period is an exceedingly punitive timeframe for failures to be “on an LRE’s record”.  We understand this definition is contained in the Tariff but believe it should be added to the list of items which require Tariff modification.

This BPM does not address the mechanism by which a delivery failure becomes either covered or non-covered. Unless this will be discussed in a future BPM, please elaborate on how an anticipated delivery failure will be solicited to other Participants to provide coverage of said failure.

In the definition for Cumulative Delivery Failure Window it states that it is a rolling wind of five Forward Showing Years. Is this correct, because APS recalls a Forward Showing Year being one year and that the Cumulative Delivery Failure Window also was one Forward Showing Year.
